Limited Warranty

Calyo delivers Evaluation/Starter/Development boards, kits, or modules, including any accompanying demonstration software, components, and/or documentation which may be provided together or separately (collectively, an “EVM” or “EVMs”) to you in accordance with the terms set forth herein. Your acceptance of the EVM is expressly subject to the following terms. 

EVMs are intended solely for product or software developers for use in a research and development setting to facilitate feasibility evaluation, experimentation, or scientific analysis of Calyo Pulse Hardware. EVMs have no direct function and are not finished products. EVMs shall not be directly or indirectly assembled as a part or subassembly in any finished product. For the avoidance of doubt, any software or software tools provided with the EVM (“Software”) shall not be subject to the terms and conditions set forth herein but rather shall be subject to the applicable terms that accompany such Software.

The EVMs are intended solely for use by technically qualified, professional electronics experts who are familiar with the dangers and application risks associated with handling electrical mechanical components, systems, and subsystems. You shall operate the EVM within Calyo’s recommended guidelines and any applicable legal or environmental requirements as well as reasonable and customary safeguards. Failure to set up and/or operate the EVM within Calyo’s recommended guidelines may result in personal injury or death or property damage. Proper set up entails following Calyo’s instructions for electrical ratings of interface circuits such as input, output, and electrical loads.

1. The Warranty

The Calyo EVMs benefit from a ninety (90) days limited warranty against defects in the materials and workmanship on the terms set out below. This limited warranty commences on the date of purchase of the EVM from Calyo, as shown on an applicable invoice, packing slip, receipt, or similar documentation. If you have a warranty claim, Calyo will repair or replace the defective Product and ship the replacement to you.

The limited warranty on any replacement Products shall terminate with the warranty of the original Product. This limited warranty applies only to the original purchaser of the Product and does not extend to subsequent owners or other third parties, except where required by applicable law.  

2. What is not covered

The limited warranty does not cover:

  • Software
  • Any hardware other than the EVM itself (including, without limitation, any product incorporating the EVM or to a product to which the EVM is mounted)
  • Defects or damage resulting, directly or indirectly, from:
    • Dismantling, disassembly, or modification of the EVM
    • Service or repair attempts carried out by anyone other than Calyo
    • Accident, misuse, abuse, or inappropriate handling
    • Use, operation, or treatment which is not in accordance with instructions provided by Calyo
    • Use or operation with hardware or software not provided by Calyo or listed as supported or compatible with the EVM
    • Installation or use in a manner inconsistent with the technical or safety laws or standards applicable in the country where the EVM is used
  • Products for which Calyo has not received payment
  • Defects which are purely cosmetic and do not affect the functionality of the EVM
  • Normal wear and tear.

3. What to do if you have a problem

If you experience a problem with your EVM, please contact our support team at [email protected] quoting the product name and serial number in the subject line. If Calyo determines that your claim is valid Calyo will issue return instructions along with a return merchandise authorisation (“RMA”) number. Proof of purchase from Calyo will be required to process a warranty claim. Any repaired or replacement EVM will benefit from the remainder of the warranty period applicable to the defective device and will not restart the warranty period.

4. Additional statement for consumers

The limited warranty set out above is in addition to other rights which may be available to you in your specific jurisdiction. This limited warranty does not affect your statutory rights.

5. Additional statement for businesses

If you are a business, Calyo’s liability for defects in materials or workmanship is limited to repair or replacement under the above limited warranty. Except for the express warranty set out above, Calyo provides no warranties or conditions, express or implied, including but not limited to any warranty or condition of merchantability, merchantability, merchantable quality, fitness for a particular purpose, performance, suitability, or non-infringement.
